The sale of the house can only be done at the Land Registry Office. Necessary documents are prepared for the sale of the house and an appointment is made with the related land registry office.
Documents Required in Title Deed

Land appointment can be taken by calling ALO 181 Land Registry and Cadastre Call Center or online. The buyer and the seller or the persons designated by these persons must be in the Land Registry at the time of appointment for the sale. The documents required for sale in the deed are:

  1. Documents required from the seller:
  • Original or photocopy of the title deed
  • 1 Photo (taken in the last 6 months, 6 × 4 size)
  • Original identity card and photocopy
  • ”There is no tax debt” letter from the municipality
  • If a proxy is to be appointed, a notarized power of attorney
  1. Documents required from the recipient:
  • 2 Photos (taken in the last 6 months, 6 × 4 size)
  • Original identity card and photocopy
  • If a proxy is to be appointed, a notarized power of attorney

Also:

  • Document Showing the Property Declaration Value received from the municipality where the immovable is located
  • Compulsory Earthquake Insurance policy (DASK)

Title Deed  Mortar 2018 – How Much is Title Deed  Mortar?

  • The declared value shall be taken as basis in the fee to be paid for the sale. At this value, the buyer and the seller pays 20% per thousand separately.
  • A revolving fund fee is also charged.

 

House Sale How?

1 a. Clarification Before Title:

  • Land Registry Fee: Under normal conditions, the Land Registry Fee paid by the buyer and seller in equal amounts can be paid to the buyer in our country. The parties should reach an agreement on how the land fee will be paid.
  • Deed Sales Fee: Deed fee is calculated over the sales price declared by the buyer and seller. In addition, if the seller has bought the house in the last 5 years, he may have to pay the Revenue Gain tax. Therefore, the parties may show the sale price at the title deed to be low. This can have serious sanctions for both sides. therefore, it should be understood that the sale price should be presented correctly.
  • Realtor Commission Fee: Considering that the seller has already agreed with the real estate agent, the important thing here is that the buyer has a prior agreement with the real estate agent about this service fee.
  • How the Payment is Made: It should be clarified how the buyer will make the payment to the seller and the upper transfer limit of the bank accounts should be checked.

1b. Things to do before the title deed:

  • Mortgage Survey: If the mortgage loan is to be withdrawn, interest rates and costs should be investigated and the bank should be decided.
  • Housing Loan Application: Necessary documents should be prepared and applied to the bank (for creditors)
  • DASK should be made: Compulsory Earthquake Insurance (DASK) should be made or if there should be checked.
  • Fair Value Should Be Obtained: A document that shows the Property Declaration Value should be obtained from the municipality where the house is connected and property tax payment, if any, should be made.
  • Documents to be Obtained from the Bank: Credit and mortgage documents and information of the mortgage official should be obtained (for those who will use credit)
  • Application to the Land Registry: The land owner or his / her representative must apply to the land registry office in the municipality to which it is attached together with the necessary documents.
  • Fees Payment: Appointment information comes with SMS and fees are paid accordingly.
  • Appointment with the Bank Officer: The mortgage officer of the bank must be notified of the date of the deed’s transaction. (for creditors)
  1. Home Sale Transactions in the deed:
  • Deed at the time of appointment: All buyers and sellers (or their agents) at the deed at the time of appointment should be present with identification documents
  • Witnesses for illiterate persons: If there is an illiterate buyer or seller, there should be two witnesses who are not related to consanguinity.
  • Delivery of Mortgage Receipts: Mortar receipts indicating that payment has been made must be submitted to the officer making the transaction.
  • Signatures are Signed: After the explanations and questions of the deed officer in the contracting room, the sales documents are signed by all buyers and sellers.
  • Credit Documents are Signed: If a housing loan is used, credit opening documents are signed at the bank (for creditors)

Procedures to be carried out after the title deed:

  • Invoices Should Be Moved: Both the buyer and the seller should move their invoices such as electricity, water and natural gas to their new address.
  • Change of Residence: Even if it is within the borders of the same district, because of the change of address, the Directorate of Population should move to the residence or change operations.
  • Property Tax Notification: Property tax declaration should be made within the same calendar year by the buyer. If the buyer fails to notify, the real estate tax may be charged to the seller, in which case paperwork may arise for the seller.
  • Revenue Gain Tax Payable: If the seller has bought the house in the last 5 years, it should be checked whether the income obtained as a result of the difference between the purchase and sale figures exceeds the exemption amount. If the exception set by the government is exceeded, the seller must pay income tax.
